The attorneys of Howard & Howard, PLLC are part of the prestigious legal team of Joaquin Miller and William S. Lambros, who have represented many individuals in major personal injury lawsuits throughout the United States. The firm has handled cases all over the country involving a wide variety of personal injury law. Most of their cases have been resolved on the basis of either a trial or an out-of-court settlement.
The firm’s two main offices are located in Michigan and Wisconsin, and they handle cases throughout the entire United States.
On May 7, 2021, after four days of trial, the jury saw that defendant didn’t have a case against James B. Knight. During closing arguments, however, plaintiff’s attorney, Howard & Howard Attorneys, LLC discussed how the defendants had handled the case so far, and this is where the lawsuit got its name. At this point, plaintiff’s attorney, Howard & Howard Attorneys, PLLC lost the case. The court cited numerous instances where the defendants displayed a callous disregard for the plaintiff’s rights, and the court concluded that they did not have a case against James B. Knight.
This ruling left plaintiff’s attorney, Howard & Howard Attorneys, PLLC with the difficult task of preparing and filing a motion to dismiss for lack of a case.
The court required that the plaintiff must either file a motion to dismiss within three months of the date when the trial started, or else the case would automatically be dismissed on the basis that it was brought “frivolous and worthless.” There is no statutory guidelines on the type of motion to file, but generally, motions to dismiss are expected to follow the same process as any other motion to the court. It requires meeting all of the requirements laid out in a District Court Order and must include certain personal information.
This law firm decided to fight this particular case in court, and the outcome was a very unfortunate one for all parties involved.
The plaintiff was awarded a judgment for his pain and suffering, and this amount was much less than he was seeking. The defendant, James B. Knight, failed to show up to court, and his case was immediately dismissed. This was not a pleasant outcome for the plaintiff or his attorney.
Howards & Howard attorneys feel that their clients were treated fairly in this case.
They were obviously hoping for a more favorable outcome, but even if this was not the case, the outcome was satisfactory for the client. If the case had been lost, the plaintiff may never have been compensated for his pain and suffering. The case was settled out of court, without ever going to trial. This allows both sides time to heal and allows the attorneys to get back to work on other cases.
The defendant did not show up for the scheduled motion hearing and did not submit any documents to the court.
Because there was no summary disposition, this motion failed. The judge assigned to the case assigned the responsibility of explaining the case to the defendant and giving him the chance to come in and answer questions. The defendant did not show. Instead, he just ignored the court.
The attorney representing the plaintiff did present a motion to dismiss on the day of the summary dispositions.
This motion was not available to the defendants.The judge ordered it to be filed, and the parties agreed to a stipulation of the date of the next court proceeding. Both sides then filed briefs with the court to continue the case. The plaintiff failed to file his brief, so the court did not review it. The defendant did file his brief, and the court did rule on the case.
The defendants could not win on their first motion, because the judge did not find them guilty.
This was a Majority Opinion. The court found that these two parties were not entitled to compensation for injuries they sustained while at work.
