What Are Walmart Litigation Claims and Who Are They Targeted Against?

Walmart and their extreme team of legal defense lawyers are infamous for vigorously defending lawsuits against them. That is why most of Walmart’s lawsuits take years to settle. Here are some examples of lawsuits that have been in the courts for a very long time:

There was a case brought by a Black lady who claimed she was discriminated against when she applied for a job at Walmart.

After she was hired, she was moved into the department store’s black section. Later, she was offered bottled water and cookies which did not conform to her employment contract. The company settled the case without paying her any damages. That is why her case has not been allowed to go forward.

Another case brought against Walmart involves two African-American teenagers who claim they were unfairly fired from their jobs.

They filed lawsuits against the retail giant, claiming discrimination. The case was settled out of court without any monetary settlement. It is expected that more lawsuits against Walmart will be filed in the coming months.

A recent lawsuit claims that Walmart used an informal test to determine who among its female employees were attractive enough for management positions.

One test involved how dark a person’s hair could be. The results showed a majority of women were dark haired, but a small percentage of them were light haired. According to the lawsuit, one of the plaintiffs had light colored hair while another had dark hair. A supervisor allegedly said the light haired woman did not have enough “vertical strength” to hold a position in management.

Another case involves a litigant who was wrongfully injured while on work.

The employee sued the company, claiming he suffered injuries when his work platform tipped over. He was later compensated for his injuries. A former owner of the retail outlet was also sued because some shelves in the store were not properly maintained. Warehouse owners and general managers are the most frequently sued for premises liability lawsuits.

Recently, an attorney who represented a litigant who was injured at work sued a former Walmart manager.

The former attorney represented a Hispanic employee who was injured while working. According to the attorney, this particular workplace accident is common in Walmart’s minority regions. This case is currently being processed through the courts.

In a related case, two nurses who worked at a Veterans Affairs facility filed suits against the corporation.

According to lawsuits, the corporation ignored directives from the attorney general and did not provide safety regulations for staffing in health care facilities. These lawsuits allege that the company has a policy of ignoring requests from the attorney general regarding staffing requirements and there is no system in place to monitor and enforce compliance with these requests.

There have been other incidents in which Walmart has been found liable for negligence.

In a case in which a customer was killed because a Walmart shelf had not been secured, several members of the store’s safety team were disciplined. Former store sales associate sued Walmart, claiming she suffered an injury due to defective products. Both lawsuits were ruled in favor of the plaintiffs.
